1. General information
1.1 About these Terms
These Terms & Conditions (“Terms”) govern your access to and use of the website www.subconsciously.com (the “Website”), the Subconsciously mobile applications (the “Apps”), and the content, products, features and services made available through them (collectively, the “Products”).
The Products are provided by Subconsciously, Inc. (“Subconsciously”, “we”, “us” or “our”).
“Device” means any computer, smartphone, tablet or other device used to access the Products. “You” means the person accessing or using the Products.
Please read these Terms carefully before purchasing, accessing or using the Products.
By creating an account, purchasing a subscription or otherwise accessing or using the Products, you agree to be bound by these Terms and by any other terms expressly presented to you as part of your purchase or use of a particular Product.
If you do not agree to these Terms, you should not use the Products.

1.2 Entire basis of use
These Terms, together with our Privacy Policy and any additional terms presented to you at the time of purchase, form the agreement between you and Subconsciously relating to your use of the Products.
If additional terms apply to a particular service, promotion or feature, those additional terms will apply alongside these Terms. Where there is a conflict, the specific additional terms will take priority in relation to that service, promotion or feature.
Our processing of personal data is governed by our Privacy Policy. Where personal data is transferred internationally, we use appropriate safeguards as required by applicable data protection law.
1.3 Changes to these Terms
We may update these Terms from time to time, including to reflect changes to the Products, applicable law or our business practices.
Where changes materially affect your rights or obligations, we will provide reasonable notice where required by law, for example through the Products, by email or on the Website.

2. Accounts and subscriptions
2.1 Creating an account
You may be required to create a Subconsciously account to access some or all of the Products.
When creating an account, you must provide accurate and current information and keep that information up to date.
You are responsible for maintaining the confidentiality of your account credentials and for activity occurring through your account.
If you believe your account has been accessed without your permission, contact us promptly at info@subconsciously.com.
By registering for an account, you confirm that:
- (a) the information you provide is accurate;
- (b) you will keep your account information reasonably up to date;
- (c) you are legally permitted to use the Products; and
- (d) your use of the Products will comply with these Terms and applicable law.
2.2 Account security
You are responsible for taking reasonable steps to protect your account, password and Device from unauthorised access.
You must not knowingly allow another person to use your account in a way that breaches these Terms.
Subscriptions and individual accounts may not be sold, transferred or exchanged without our written permission.
2.3 Children and young people
Many Subconsciously recordings may be suitable for young people aged 11 and above, particularly teenagers.
Children aged 11 or 12 should use Subconsciously with the involvement of a parent or legal guardian. Where parental consent is required by applicable data protection law or the relevant app platform, that consent must be provided before the relevant personal data is processed or account functionality is used.
Users aged 13 to 17 should use content appropriate to their age, needs and circumstances, with parental or guardian involvement where appropriate or required by law.
Parents and guardians are responsible for determining whether particular content is appropriate for a younger user under their supervision.
Some Subconsciously content addresses adult subjects and may not be appropriate for children or younger teenagers. Users should select age-appropriate sessions.
2.4 Communications
If you create an account, we may send you communications necessary to operate the Products, including information relating to your account, subscription, security or important service updates.
Where permitted by law and where any required consent has been obtained, we may also send marketing communications, special offers or surveys.
You can unsubscribe from marketing emails using the unsubscribe link provided in those communications.
You may manage push-notification permissions through your Device settings.
3. Subscriptions and payments
3.1 Subscription options
Subconsciously offers paid subscription plans, which may include monthly and annual options.
The subscription options, prices, trial periods and other material terms available to you will be displayed before you complete your purchase.
Subscriptions may be purchased through the Apple App Store, Google Play, the Website or another payment method made available by Subconsciously.
3.2 Automatic renewal
Unless expressly stated otherwise when you subscribe, paid subscriptions automatically renew at the end of each subscription period until cancelled.
The applicable subscription price and billing frequency will be shown before purchase.
You are responsible for cancelling your subscription before the next renewal if you do not wish it to renew.
Where required by applicable law, we or the relevant payment provider will give you information or notices relating to renewals, price changes or cancellation rights.
3.3 Monthly subscriptions
A monthly subscription is charged at the applicable monthly rate shown at the time of purchase.
Unless cancelled, it will continue to renew for successive subscription periods.
3.4 Annual subscriptions
An annual subscription is charged at the applicable annual rate shown at the time of purchase.
Unless cancelled, it will continue to renew for successive annual subscription periods.
3.5 Trials and promotional offers
From time to time, we may offer free trials, introductory prices, promotional subscriptions or discount codes.
The specific terms of any such offer will be displayed at the time it is made available.
Unless stated otherwise, a trial or introductory offer may automatically convert into a paid subscription at the end of the promotional period. You must cancel before conversion if you do not wish to continue with the paid subscription.
Promotional offers may be limited to eligible users and may not be combined unless expressly stated.
3.6 Payment processing
Where you purchase a subscription through the Apple App Store or Google Play, payment is processed by the relevant platform and your purchase is also subject to that platform’s applicable payment terms.
Where payments are made directly through the Website or another Subconsciously payment method, they may be processed by a third-party payment provider.
Subconsciously does not directly store your complete credit or debit card details.
You are responsible for any applicable charges, taxes or fees disclosed as part of the purchase process.
3.7 Price changes
We may change our subscription plans or prices from time to time.
Any price change affecting an existing subscription will take effect only after appropriate notice and in accordance with applicable law and the rules of the relevant payment platform.
If you do not wish to accept a proposed price change, you may cancel your subscription before the new price takes effect.
4. Cancellation and refunds
4.1 Cancelling your subscription
You may cancel your subscription at any time.
If you subscribed through the Apple App Store, you should manage or cancel your subscription through your Apple subscription settings.
If you subscribed through Google Play, you should manage or cancel your subscription through your Google Play subscription settings.
If you subscribed directly through Subconsciously, follow the cancellation instructions provided through your account or contact us at info@subconsciously.com.
Unless otherwise required by law, cancelling a subscription prevents future renewals but does not normally terminate your access before the end of the subscription period you have already paid for.
4.2 Refunds and consumer rights
Refund eligibility may depend on how you purchased your subscription, the relevant payment platform and applicable consumer law.
Purchases made through the Apple App Store or Google Play may be subject to the respective platform’s refund procedures.
Nothing in these Terms limits any refund, cancellation or other consumer rights that you have under applicable law.
4.3 Cancellation or suspension by Subconsciously
We may suspend or terminate your access to the Products where reasonably necessary, including where:
- (a) you materially breach these Terms;
- (b) you use the Products fraudulently or unlawfully;
- (c) you attempt to gain unauthorised access to the Products or our systems;
- (d) you unlawfully copy, distribute or exploit Subconsciously content; or
- (e) suspension or termination is reasonably necessary to protect Subconsciously, our users or third parties.
Where appropriate and reasonably practicable, we will provide notice before terminating an account.
5. Acceptable use
You agree to use the Products only for lawful, personal purposes and in accordance with these Terms.
You must not:
- (a) introduce viruses, malware or other harmful computer code into the Products;
- (b) interfere with, damage, disable or disrupt the Products, servers or networks;
- (c) attempt to gain unauthorised access to any part of the Products, accounts, systems or data;
- (d) impersonate another person or misrepresent your identity;
- (e) use the Products for an unlawful, fraudulent, harmful or abusive purpose;
- (f) circumvent security, subscription or access restrictions;
- (g) scrape, extract or systematically collect content or data from the Products without our written permission;
- (h) reverse-engineer, decompile or attempt to derive the source code of the Products except where applicable law expressly permits this;
- (i) reproduce, redistribute, sell or commercially exploit the Products or their content without our written permission; or
- (j) use the Products, recordings or underlying methodology for commercial research, training, artificial-intelligence training, competitive analysis or development of a competing product without our prior written permission.
We may take reasonable action to protect the Products and enforce these Terms where prohibited activity occurs.
6. Intellectual property
6.1 Ownership
The Products and the content made available through them, including audio recordings, scripts, text, graphics, designs, software, video, branding, trademarks and other materials, are owned by or licensed to Subconsciously and are protected by applicable intellectual property laws.
Except for the limited licence granted under these Terms, no ownership rights are transferred to you.
6.2 Your licence to use Subconsciously
Subject to these Terms and payment of any applicable subscription fees, Subconsciously grants you a limited, personal, non-exclusive, non-transferable and revocable licence to access and use the Products for your own non-commercial purposes.
You may use any offline-listening or download functionality provided within the Apps only through the functionality made available by Subconsciously.
An in-app download does not transfer ownership of the recording or give you the right to extract, copy or distribute the underlying audio file.
6.3 Restrictions
Unless expressly permitted by Subconsciously, you must not:
- (a) copy or reproduce recordings or other content;
- (b) distribute, broadcast, republish or publicly perform content;
- (c) make content available to other people outside the functionality provided by Subconsciously;
- (d) modify, translate or create derivative works from the Products;
- (e) sell, license or commercially exploit any part of the Products;
- (f) remove or alter copyright, trademark or proprietary notices;
- (g) bypass digital-rights-management or access-control technology; or
- (h) use Subconsciously content to create, train or develop another commercial product or service.
6.4 Trademarks
The Subconsciously name, logo and associated branding are trademarks or other intellectual property belonging to Subconsciously or its licensors.
Nothing in these Terms grants you the right to use our branding without prior written permission.
7. Availability and changes to the Products
We aim to provide a reliable and high-quality service but cannot guarantee that the Products will always be uninterrupted or free from faults.
Access may occasionally be restricted or unavailable due to maintenance, updates, technical problems, security issues or circumstances beyond our reasonable control.
We may update, improve, replace or discontinue features or content where reasonably necessary.

Nothing in this section affects any statutory rights you may have in relation to digital content or services.
8. Third-party services and links
The Products may contain links to, integrations with or functionality provided by third-party websites, platforms or services.
Those third parties may have their own terms and privacy policies.
Subconsciously does not control third-party services and is not responsible for their availability, content or privacy practices.
A link to a third-party service does not necessarily constitute an endorsement by Subconsciously.
9. General product disclaimer
Information provided through Subconsciously is intended for general wellbeing, self-development and informational purposes.
While we endeavour to keep our content useful and accurate, individual experiences and results will vary.
No particular result or outcome is guaranteed through use of the Products.
You remain responsible for deciding whether particular content is appropriate for your individual needs and circumstances.
10. Health and medical disclaimer
10.1 General purpose
Subconsciously provides hypnosis and behaviour-change content for general wellbeing and self-development.
Subconsciously is not a medical service or medical device, and the Products do not provide medical diagnosis, treatment or personalised medical advice.
10.2 Professional healthcare
Content provided through Subconsciously is not intended to replace advice, diagnosis or treatment from a qualified healthcare professional.
If you have concerns about your physical or mental health, you should seek appropriate professional advice.
Do not delay seeking professional healthcare because of information or content provided through Subconsciously.
10.3 Emergencies
Subconsciously is not an emergency or crisis service.
If you believe that you or another person is in immediate danger or requires urgent medical assistance, contact the appropriate emergency services.
10.4 Individual responses
People can respond differently to hypnosis and therapeutic content.
If a session causes significant distress, discomfort or worsening symptoms, stop using it and seek advice from an appropriate healthcare professional.
10.5 Safety when listening
Do not use hypnosis sessions while driving, operating machinery or undertaking any activity requiring your full attention.
Use the Products only in a safe environment where becoming deeply relaxed or focused will not create a risk to you or another person.
10.6 Results
Although hypnosis may be useful for a range of wellbeing and behaviour-change goals, Subconsciously does not guarantee that any particular session, programme or use of the Products will produce a particular result.
11. End-user licence
Subject to these Terms and payment of any applicable subscription fees, Subconsciously grants you a limited, non-exclusive, non-transferable and revocable licence to use the Apps and Products for personal, non-commercial purposes.
You agree that you will not, and will not assist another person to:
- (a) copy, reproduce, modify, reverse-engineer, decompile or disassemble the Products except where applicable law expressly allows it;
- (b) use the Products to create another software application, audio product or competing service;
- (c) rent, lease, sell, sublicense or distribute the Products;
- (d) circumvent technologies used to protect content or subscriptions;
- (e) circumvent territorial or access restrictions; or
- (f) otherwise use the Products in breach of these Terms.
All ownership and intellectual property rights in the Products remain with Subconsciously or its licensors.
12. Copyright complaints
We respect intellectual property rights.
If you believe that content made available through the Products infringes copyright or another intellectual property right that you own or are authorised to enforce, please contact:

Your notice should include sufficient information for us to identify the relevant material, understand the basis of your complaint and contact you.
Where appropriate, we may remove or restrict access to content while a legitimate intellectual property complaint is investigated.
13. Feedback and suggestions
If you voluntarily provide feedback, ideas or suggestions about Subconsciously, you agree that we may use that feedback to develop, improve or operate our Products without an obligation to compensate you.
This does not give Subconsciously ownership of personal information you provide, which remains subject to our Privacy Policy.
14. Liability
14.1 Your statutory rights
Nothing in these Terms excludes or limits any rights or remedies that cannot lawfully be excluded or limited, including applicable statutory consumer rights.
14.2 Matters we do not exclude
Nothing in these Terms excludes or limits liability for:
- (a) death or personal injury caused by negligence where liability cannot lawfully be excluded;
- (b) fraud or fraudulent misrepresentation; or
- (c) any other liability that cannot legally be excluded or limited.
14.3 Use of the Products
You are responsible for using the Products appropriately and in accordance with these Terms and any safety guidance provided within the Products.
To the extent permitted by law, we are not responsible for losses that result from:
- (a) misuse of the Products;
- (b) use contrary to safety instructions;
- (c) circumstances outside our reasonable control;
- (d) unauthorised access resulting from your failure to protect your account credentials; or
- (e) third-party platforms or services outside our control.
14.4 Business losses
The Products are provided primarily for personal and consumer use.
If you use the Products for a business or commercial purpose without our written agreement, to the extent permitted by law we will not be responsible for loss of profit, loss of business, business interruption or loss of business opportunity arising from such unauthorised commercial use.
14.5 Digital content
Nothing in these Terms removes or restricts your statutory rights where digital content supplied by us is faulty, does not match its description or otherwise fails to meet applicable legal requirements.
15. Indemnity for unlawful or commercial misuse
To the extent permitted by law, if you use the Products for an unauthorised commercial purpose or deliberately use them unlawfully in a way that causes Subconsciously to suffer a third-party claim or loss, you will be responsible for the reasonable losses arising directly from that conduct.
This section does not apply to ordinary consumer use of the Products and does not affect your statutory rights.
16. Account deletion
You may request deletion of your Subconsciously account using the account-deletion functionality provided within the App or by contacting:

When an account is deleted, associated personal data will be deleted or anonymised except where we are required or permitted to retain particular information for legal, regulatory, security, fraud-prevention or financial record-keeping purposes.
Further information about how we process and retain personal data is provided in our Privacy Policy.
17. Electronic communications
We may communicate with you electronically, including by email, in-app notification or notices displayed through the Products.
Where applicable law allows information or notices to be provided electronically, such communications may satisfy requirements for written communication.
You may retain electronic communications by downloading, saving or printing them.

We may send notices to the email address associated with your account or through the Products where permitted by law.
19. Transfer of this agreement
We may transfer our rights and obligations under these Terms as part of a reorganisation, sale, transfer or other legitimate business transaction, provided that doing so does not reduce your rights under these Terms or applicable law.
You may not transfer your account or rights under these Terms to another person without our consent.
20. Force majeure
We will not be responsible for a failure or delay in providing the Products where this results from circumstances outside our reasonable control.
This may include failures of telecommunications networks, hosting providers, app platforms or other essential infrastructure; natural disasters; acts of government; widespread outages; or other events that we could not reasonably prevent.
Nothing in this section affects rights that applicable consumer law gives you.
21. No waiver
If we delay or fail to exercise a right under these Terms, this does not mean that we waive that right.
A waiver relating to one circumstance will not automatically apply to another circumstance.
22. Severability
If any provision of these Terms is found to be unlawful, invalid or unenforceable, that provision will be treated as removed or modified only to the extent necessary.
The remaining provisions will continue in effect.
23. Third-party rights
Unless expressly stated otherwise, a person who is not a party to these Terms has no right to enforce them.
24. Entire agreement
These Terms, our Privacy Policy and any additional terms expressly applicable to your purchase or use of a Product constitute the agreement between you and Subconsciously concerning your use of the Products.
They supersede previous arrangements, understandings or agreements relating to the same subject matter.
Nothing in this section excludes liability for fraud or fraudulent misrepresentation.
25. Governing law and jurisdiction
These Terms are governed by the laws of England and Wales.
If you are a consumer, you may also have mandatory rights under the laws of the country in which you live. Nothing in these Terms affects those rights.
Any dispute arising from or relating to these Terms will be subject to the jurisdiction of the courts of England and Wales, except where applicable consumer law entitles you to bring proceedings elsewhere.
